Terms & License

EtchMind is desktop software made by an independent developer acting in trade as a sole trader in New Zealand ("we", "us"). These terms cover your use of the EtchMind application and website. By installing or using EtchMind you agree to them.

In plain language: your collection stays yours and on your computer; the 30-day trial needs no account or card; Annual renews yearly until cancelled; Lifetime Supporter is one payment; and every purchase has a 14-day money-back guarantee. The details below explain those promises and do not limit rights the law gives you.

1. Your license

EtchMind is sold two ways. Both grant a non-exclusive, non-transferable license for your own use, activated on up to 3 computers you personally use; you can deactivate a machine at any time to free a seat for another.

  • Annual plan: a yearly subscription. While it is active you receive every desktop application update we release. If it ends — because you cancel or a renewal fails — your right to use the software does not end: the version you have installed remains usable on compatible activated machines, offline. Only delivery of new updates stops, and activating additional machines may require an active plan. Resubscribing restores update delivery. We cannot guarantee compatibility with future operating-system changes after update delivery stops.
  • Lifetime Supporter license: a one-time purchase that never expires and includes all future EtchMind desktop application updates we release, as defined below.

What "lifetime" means: the lifetime of the EtchMind product, not a person's lifetime — every update we release for as long as EtchMind is actively developed and offered for sale. EtchMind is local-first software with no server dependency for your collection or daily study after activation, so if development ever permanently ceased, installed versions should remain usable on compatible machines and your data would remain accessible and exportable. Email support is included with all licenses while EtchMind is actively sold. Optional hosted services with ongoing server or API costs, such as future cloud storage, hosted sync, hosted AI, or collaboration, are not included in Annual or Lifetime Supporter unless they are explicitly included at purchase.

2. Free trial

The trial gives you the full application for 30 days at no cost, with no account or payment card required. When the trial ends, reviewing and adding material pause, but your data remains fully accessible and exportable. One trial per person. We may occasionally extend or reset trial windows as a courtesy, but that does not create a right to repeated trials.

3. Purchases, renewal, taxes and refunds

Purchases are processed by Lemon Squeezy (a Stripe company) as merchant of record — they are the seller of the transaction, handle payment processing, and collect and remit any applicable sales tax or VAT. Their terms apply to the payment itself.

Prices on etchmind.com are shown in USD and exclude applicable taxes until checkout. Lemon Squeezy shows the final total, including any tax, before you place an order. The current list prices are US$49/year for Annual and US$199 once for Lifetime Supporter.

Annual plan renewal: the Annual plan renews automatically every 12 months at the rate you signed up at. You will receive a reminder email before each renewal charge, and you can cancel at any time using the link in your receipt email or Lemon Squeezy's customer portal, without contacting support. Cancellation stops all future charges and never disables the software (see section 1). As long as your subscription remains continuously active, your renewal price will not increase.

Lifetime Supporter purchases are one-time payments; nothing about them recurs.

Limited Lifetime Supporter promotion: code SUPPORTER25 reduces the US$199 list price by 25%, producing US$149.25. It is valid through 1 October 2026. After that deadline, Lifetime Supporter returns to the US$199 list price and this 25%-off offer will not be repeated. Confirm that the discount appears in the final checkout total before paying; if it does not, do not complete the order and contact support. A licence bought during the offer is otherwise identical to one bought later.

Refunds and disputes: if EtchMind isn't for you, email support@etchmind.com within 14 days of purchase and we'll refund you in full to the original payment method, subject to normal payment-network processing times. This sits alongside — and never limits — any statutory rights you have where you live, including rights under the New Zealand Consumer Guarantees Act where it applies. For any other billing problem or dispute, contact us first and we'll help resolve it promptly with Lemon Squeezy.

4. What you may not do

  • Share, resell, or publish your license key, or activate it for people other than you.
  • Circumvent or disable the licensing or trial mechanisms.
  • Reverse engineer or modify the software, except where law expressly permits it.
  • Redistribute the application itself (sharing the download link is fine — encouraged, even).

We may revoke license keys obtained or used in breach of these terms, or refunded or charged-back after activation.

5. Your data and content

Everything you import into EtchMind stays on your computer and remains yours; we claim no rights over it and have no access to it. The app includes backup and export tools, and you are responsible for keeping backups — as with any local-first software, we can't recover data we never had. You're also responsible for ensuring you have the right to use the materials you import for personal study.

6. Updates and changes

We expect to improve EtchMind continually, but specific future features, platforms, and timelines aren't promised unless stated in writing at purchase. Updates may change functionality as the product develops, but they do not retroactively reduce the licence or update entitlement you bought. Updates are delivered through the app's built-in updater and are cryptographically signed. Update delivery on the Annual plan requires an active subscription; the software itself never requires one (section 1). Future optional online services with ongoing hosting, storage, AI/API, or collaboration costs may have separate terms and pricing if they are offered.

EtchMind is currently early launch software. We test updates and work to protect local collections, but bugs and compatibility issues may still occur, so you should keep backups of important data.

7. Warranty and liability

EtchMind is early-launch software and is provided "as is" where the law allows. Nothing in these terms excludes or limits a statutory guarantee, remedy, or liability that cannot lawfully be excluded or limited, including applicable rights under the New Zealand Consumer Guarantees Act 1993. Subject to those rights, we are not responsible for losses that were not reasonably foreseeable, business losses from consumer use, or data loss caused by misuse or a failure to keep reasonable backups. To the maximum extent permitted by law, our total liability relating to the software is limited to the amount you paid for it. This limit does not restrict the 14-day refund promise above.

8. Resolving problems

Please email support first so we can try to put things right promptly. Nothing in these terms prevents you from using any regulator, tribunal, court, chargeback, or other remedy available under applicable law.

9. General

These terms are governed by the laws of New Zealand, while mandatory protections in your country still apply. If we update these terms, the effective date above changes and material changes will be identified. Changes apply prospectively and will not retroactively reduce a paid licence or update entitlement. Where the law requires fresh consent, we will ask for it. If any clause is found unenforceable, the rest remain in effect.
